|
Save The Date: The Full Adams Morgan Farmers Market opens Saturday June 6, 2020 with The Licking Creek Bend Farm, Ravenhook Bakehouse, and Remie's Flowers and Plants. The market will observe City approved social distancing as well as extra health and safety precautions.
Licking Creek Bend Farm has established a CSA Subsidy Program for first responders, essential service providers and families deeply impacted by the pandemic. Additionally, you should be aware that the IRS clarified the interplay between PPP loans and the Social Security Deferral Election program. With this guidance, employers who obtain a PPP loan can defer employer Social Security payroll taxes up until the date that any portion of the PPP loan is forgiven.
After you receive a decision from your lender that your PPP loan is forgiven, you are no longer eligible to defer payment of employer Social Security payroll taxes and you must resume payment of those taxes. However, the amounts already deferred are not due immediately. They will be due in two installments, with 50% due on December 31, 2021 and the other 50% due on December 31, 2022.
Accordingly, if you received a loan and are deferring Social Security taxes, once the loan is forgiven, in whole or in part, please notify ADP immediately of the need to stop your Social Security tax deferral, which ADP will implement with the next payroll. Please also keep in mind that if you receive a PPP loan, you are not eligible to take the Employee Retention Tax Credit.

As we await major changes to PPP with Congress considering the HEROES Act and a potential vote on it tomorrow as Speaker Pelosi brings the bill to the floor, there is a quick PPP update that is relevant for businesses that were approved for PPP. The Treasury Department extended the deadline for decisions to return PPP funds through Monday 5/18, from the previous deadline which was today, 5/14. For anyone who has received a PPP loan and is still deciding if PPP is right for you, you now have several more days to review your situation and make a choice.

The Mayor signed the Council’s Emergency Legislation into law yesterday, which provides for a 15% cap on third party delivery service fees. The cap is in effect now through the end of the Public Emergency, which has been extended until June 8th. There are conversations to extend this relief beyond that date. More to come on that.
The SBA,
just added Item #46 to its PPP FAQ, indicating that, "Any borrower that, together with its affiliates, received PPP loans with an original principal amount of less than $2 million will be deemed to have made the required certification concerning the necessity of the loan request in good faith."
Matt Hetrick of Harmony Group believes that PPP FAQ #46 provides clear guidance for any restaurant with loans of under $2,000,000 in aggregate who were on the fence with the question of whether or not they needed to return their PPP loans due to uncertainty about whether the certifications they made in taking the loans were in good faith.
Finally, the national industry leaders on food safety protocol, ServSafe, have a new course that provides best practices for employees of a restaurant preparing to reopen a dining room following a state shutdown including best practices for safety, hygiene, cleaning and disinfecting, and social distancing. Yesterday, Mayor Muriel Bowser signed the
Coronavirus Omnibus Emergency Amendment Act of 2020
into law. Included are several provisions that will help deliver financial relief to ABC licensees, promote social distancing, and allow for community input.
Title 25 has been amended to allow:
-
Carryout and delivery pop-ups
—on-premises retailer licensees, may sell beer, wine, and spirits with prepared food for carry-out and delivery from an additional location including private outdoor space or an existing permitted sidewalk café for up to 30 days. Operations may be conducted from 7:00 a.m. to midnight seven days a week.
Advance registration with ABRA
is required.

Safekeeping
—the 21 days that an establishment has to place its license in safekeeping after closing is tolled during the public health emergency.
-
Electronic signatures
—applications can be signed by electronic signature or through the submission of a scanned copy of the original signature.
-
Self-certification
—applicants can now self-certify all liquor license applications, including new, renewal, manager’s and solicitor’s license applications. As such, applications are not required to be notarized.
-
Protest period
—all persons and groups with standing have 66 days—up from 45—to file a protest. Previous emergency legislation extended the protest period to 66 days only for ANCs.
-
Electronic notification
—required application notices to ANCs now only need to be sent to an ANC’s DC government-issued email address. Electronic notice still needs to be provided to the Council and the Office of Advisory Neighborhood Commissions.
The Emergency Act will remain in effect for 90 days.
