Important Update Regarding New Bar and Restaurant Operating Rules

The ABC Board has issued new operating opportunities, including those not revealed at Mayor Bowser’s Monday news briefing…
Effective Saturday, May 1:
-
Operating curfew remains 12Midnight, both indoors and outdoors
-
Capacity limit remains 25% for indoor service – there is no capacity limit for outdoor service.
-
All patrons must be seated at all times.
-
Patron seating at functional or staffed service bars remains prohibited.
-
Table seating maximum increased from 6 to 10, both indoors and outdoors.
-
Patrons seated outdoors will no longer be required to order one food item per table, but must order at least one food item per table indoors.
-
Venues with an ABC license entertainment endorsement will be allowed to offer DJs, Live Music, Comedy Shows, Drag Shows, Trivia, etc., both indoors and outdoors – but only at a sound level that does not require patrons to speak at greater than a conversational level – and outdoors only until 10PM (but not in parklets or the street) and indoors until the current 12Midnight operating curfew.

Venues that have a Settlement Agreement with an ANC, ‘citizens group’ or license protest group(s) restricting or prohibiting outdoor live music or entertainment may attempt to get the ANC or other group(s) to waive the agreement.

SPECIAL NOTE: Outdoor entertainment restrictions by Settlement Agreement do NOT apply to special 'pandemic period’ permits to use outdoor space such as sidewalk cafe and other outdoor spaces that were not pre-existing or having been subject to standard licensing processes.
-
DJs and performers must be masked unless it hinders performance (e.g., singer, musician playing instrument using mouth).
-
Performers must be positioned a minimum of 12-ft away from patrons if masked, 18-ft away from patrons if unmasked.
-
Performers must remain 6-ft away from each other.
-
There may be no more than 10 performers ‘on stage’ at the same time if indoors, no more than 5 performers ’on stage’ at a time if outdoors.
-
Activities such as dancing, or playing darts, arcade games, table pool or ping-pong, and all other activities requiring patrons to stand or cluster in groups and away from being seated at a table are not allowed.
-
Venues licensed as a Multipurpose Facility, and concert venues, may now open at 25% capacity (up to 500) but must adhere to all physical distancing and other rules, and all patrons must remain seated.
-
Weddings and Special Events are now allowed at 25% capacity (with a waiver for attendance greater than 250) but must adhere to all venue physical distancing and other rules, and attendees must remain seated during event.

The Modified Measures in Phase Two of Washington, DC Reopening Information Session will delve into key provisions included in Mayor’s Order 2021-060 and related ABC Board emergency rulemaking impacting alcohol establishments. The Mayor’s Order and emergency rulemaking takes effect Saturday, May 1, 2021
Key topics to be addressed include:

Expanded table seating capacities for patrons from six (6) to ten (10) persons.

Elimination of the prepared food requirement to purchase alcohol by patrons seated outdoors.
-
Resumption of live entertainment where patrons are seated and performers distanced, in addition to other specific conditions.
-
Resumption of live music accompanying dining outdoors on licensed summer gardens and sidewalk cafes.
-
Reopening recreational facilities, museums, and multipurpose facilities that serve food and drink in compliance with restaurant rules, including table service and seated dining only.

Previously announced modifications pertaining to service hours and capacity maximums continue to apply and will be discussed during the session.

Capital COVID-19 Snapshot:
Planning for the Return to Worksites
|
The Partnership works to bring people, organizations, and jurisdictions together to make the Capital Region – from Baltimore to Richmond – one of the best places to live, work, and build a business. In September 2020, we published the results of the first Capital COVID-19 Snapshot, designed to increase regional information and data sharing, so employers, both large and small, could make more informed decisions about reopening, and so public agencies could better understand when employees are expected to return to their offices and worksites. The first Snapshot told us that employers were adopting a phased approach to reopening and on average did not expect most of their workforce back on site until Summer 2021, among other findings which can be found here.
The second Capital COVID-19 Snapshot was conducted between November 11-December 11, 2020 with 172 unique employers participating from the Washington, Baltimore, and Richmond metro areas. Along with an update of employer reopening plans, the Snapshot includes the Transit Tracker with data provided by regional transit agencies and a new Back to Work Barometer through a partnership with Kastle Systems - both regularly updated with the newest data.

Small Business Scavenger Hunt! May 10-22

The hunt will center around neighborhoods in all eight Wards and include fun missions that get you out into the city. Small businesses can now get thousands in tax credits for vaccine PTO. Here's how it works.
|
Many businesses now have another reason to encourage employees to get vaccinated for Covid-19: thousands of dollars in potential tax credits per employee.
The tax credits, funded by the American Rescue Plan, are one facet of President Joe Biden’s plan to encourage employers to use their resources to encourage vaccinations among their employees.
Experts say it’s better for employers to encourage, rather than require, the vaccine. Many businesses already offer paid leave for employees to be vaccinated, but the newest tax credits offer a potentially lucrative new avenue for businesses looking to encourage vaccinations.
The Internal Revenue Service and the U.S. Department of the Treasury issued
details and guidelines for the tax credits
on Wednesday.

In Federal Relief, the SBA announced Tuesday that the RRF application will open in two parts:

Registration on Friday, April 30, 2021, at 9 a.m. EDT
(if not applying via POS system)

Application opens on Monday, May 3, 2021, at noon EDT
In preparation, the SBA recommends applicants familiarize themselves with the application process in advance to ensure a smooth and efficient application experience, specifically by:

A reminder: All eligible applicants should submit applications as soon as the portal opens. For the first 21 days that the program is open, the SBA will prioritize funding applications from businesses owned and controlled by women, veterans, and socially and economically disadvantaged individuals. The 21-day period only applies to who gets funded in what order, and NOT to who can apply when.
We’ve received many questions on who this 21-day period applies to and how these definitions apply. Under SBA, a business must be at least 51% unconditionally and directly owned by one or more of these defined groups. Here are the federal government definitions of who is included in these groups:

In DC, it remains all the more frustrating to be operating without a roadmap for reopening benchmarks, especially as nearby jurisdictions are putting plans and benchmarks in place. As you know, RAMW is in daily conversations and is advocating with the Mayor’s office, stakeholders close to her, and business leaders in the District to push the city to reopen further and to tell us when and how that can happen based on vaccination progress. In parallel efforts, there are plans to 1) engage the Council in a more strategic way to offer transparency and movement for reopening, and 2) share a toolkit to provide talking points, data, and resources for YOU as we mobilize restaurant operators to be vocal about reopening, about what operators want and need, and what your customers are demonstrating in terms of their own desires and demand we are seeing for dining out.

Notice is hereby given that, pursuant to section 19 of the Business Improvement Districts Act of 1996, effective May 29, 1996 (D.C. Law 11-134; D.C. Official Code § 2-1215.18) (“Act”), the Department of Small and Local Business Development (DSLBD) will hold a public hearing on the recertification of the Adams Morgan Partnership Business Improvement District.
The public hearing will be held at 2:00 pm on
Monday, June 21, 2021 in Suite 850N, 441 4th Street NW, Washington, D.C.
DSLBD Director Kristi Whitfield has informed the Adams Morgan Partnership Business Improvement District that the filing criteria set forth in D.C. Official Code § 2-1215.18 have been met and their application is otherwise in conformity with the Act.
The BID application is available for review by the public during normal business hours on weekdays at 1640 Columbia Road, N.W., in the offices of the Adams Morgan Partnership Business Improvement District; and by the public online at:
